Abstract: They mention it a lot in their books. The scientists have stated from this principle a fiqh base ”usual is govern”. It is oneof the six big bases from which a lot of principles have come. Even the contemporary for convention. They call it a convention theory. It includes a lot of fiqh implementation from a different gates in Islamic fiqh. The law scientists give a special attention to this principle because of its importance in stating laws that associated with family. Fuqha give agreat attention to the matters that concerned with family they clearify these matters through texts from al-Quran , al-Sunnah and consensus . They confirm that from other proofs other than those texts. And this will be our concern in this study.
